Terms and Conditions

By using the PIXEO website (pixeoapp.com) or mobile app, you agree to these Terms and Conditions. If you do not agree, please do not use our services.

These terms apply to all users of PIXEO, including visitors, registered users, and Pro subscribers.

PIXEO Inc. reserves the right to update these terms at any time. When we make significant changes, we will notify registered users by email. Continued use of PIXEO after changes are posted constitutes your acceptance of the updated terms.

PIXEO is a photography location discovery platform operated by PIXEO Inc., a Canadian company based in Ottawa, Ontario. We operate the PIXEO website and mobile app, which together form a curated collection of verified photo spots around the world.

Our mission is to help photographers of all skill levels find and share extraordinary locations.

• You must be 18 years of age or older to create a PIXEO account.
• You are responsible for maintaining the confidentiality and security of your account credentials.
• You may sign in via email and password, Apple Sign In, or Google Sign In.
• You may delete your account at any time through the website or by contacting us at oc.oexip@ofni.
• PIXEO reserves the right to suspend or terminate accounts that violate these terms, without notice.

You are responsible for all activity that occurs under your account. If you suspect unauthorized access, contact us immediately.

Free Accounts

All registered users can:

• Browse and search photo spots on the map
• Submit photo spots for review
• Access Photography Guides articles
• Participate in the monthly Photo Challenge

Pro Accounts

Pro subscribers additionally receive:

• Access to the Trip Planner tool on the website
• A Pro badge on their profile
• Nearby Locations feature in the PIXEO app
• Ad-free experience in the app
• Additional features as they are added over time

Pro subscriptions are managed through the PIXEO mobile app. Pricing, billing, and cancellation are governed by Apple App Store or Google Play Store terms where applicable. PIXEO does not process payments directly on the website. Subscription fees are non-refundable except as required by applicable law or platform policy.

Users may submit photo spots for inclusion in the PIXEO collection. By submitting content, you agree that:

• The photo is your own original work.
• You own the copyright, or have explicit written permission from the copyright holder to submit it to PIXEO.
• Using another photographer's image without their consent will result in immediate removal from all PIXEO platforms and termination of your account.
• All submissions are reviewed by PIXEO staff before publication. We do not guarantee acceptance of any submission.

Common Reasons for Rejection

The following are common reasons a submission may be declined. This list is not exhaustive. PIXEO staff use their discretion in all moderation decisions.

• Moving subjects: photos where people, animals, or vehicles are the primary focus
• Too close or macro: does not clearly show the surrounding location
• Technical quality: out of focus, poorly exposed, or heavily edited in a way that misrepresents the location
• AI-generated images: photos that are partially or entirely generated by artificial intelligence are not permitted
• Inappropriate content: see Content Standards below
• Inaccurate geotag: location pin is more than 50 metres from the actual photo location
• Private property or trespassing: photos taken in locations requiring unauthorized access
• Duplicate location: too close to an existing pin in our collection

You retain full copyright on all photos you submit to PIXEO. However, by submitting content you grant PIXEO Inc. a worldwide, royalty-free, non-exclusive license to:

• Display your photo on the PIXEO website and mobile app
• Use your photo in PIXEO marketing materials, newsletters, and social media posts
• Include your photo in PIXEO Photo Challenges and contests

This is consistent with standard terms on image-sharing platforms. PIXEO will always attribute photos to the submitter wherever technically possible. PIXEO will never sell your photos to third parties without your explicit written consent.

If you delete your account, your submitted photos may remain in the PIXEO collection, attributed to your username where possible. To request removal of a specific photo, contact oc.oexip@ofni. Photo removal requests will be honoured within 30 days of receipt. For full details on how we handle personal information upon account deletion, please refer to our Privacy Policy.

All content submitted to PIXEO, including photos, descriptions, and comments, must meet our content standards. We do not accept:

• Pornographic, sexually explicit, or suggestive content
• Racist, bigoted, misogynistic, homophobic, or hateful content of any kind
• Content that promotes violence or illegal activity
• Content that infringes on third-party intellectual property rights
• Spam, misleading descriptions, or fabricated location data
• Photos taken on private property without the owner's permission
• Photos of dangerous locations that could encourage unsafe behaviour in others
• AI-generated images: photos that are partially or entirely generated by artificial intelligence

PIXEO moderates all submitted content and reserves the right to remove any content, at our sole discretion, without notice or explanation.

PIXEO runs an ongoing monthly Photo Challenge. The following rules apply:

• All approved photo submissions are automatically eligible for the monthly Photo Challenge.
• Only persons 18 years of age or older are eligible for prizes.
• PIXEO Inc. employees and their immediate family members are ineligible to win.
• The monthly prize is an Amazon gift card valued at $100 USD. The annual prize value is announced separately.
• Prizes are not transferable and cannot be exchanged for cash. Winners may request that their prize be donated to a registered charity of their choice instead.
• Winners are notified by email within 30 days of announcement and must respond within 30 days to claim their prize. Unclaimed prizes are forfeited.
• Winners' names and submitted photos may be publicly disclosed by PIXEO.
• Vote manipulation, including the use of bots, IP spoofing, macros, or coordinated artificial voting, results in immediate disqualification.
• PIXEO's decision on all contest matters is final.
• PIXEO reserves the right to cancel, modify, or discontinue contests at any time.

Photo spot locations in the PIXEO collection are submitted by users and verified by PIXEO staff to the best of our ability. However, we cannot guarantee the accuracy, safety, or accessibility of any location.

• PIXEO does not guarantee the accuracy of any location data, GPS coordinates, or access information.
• Conditions at locations change. What was safe or accessible when a photo was submitted may no longer be so.
• Always check local regulations and any applicable permits or restrictions before visiting a location.
• Always assess safety conditions yourself before entering any location. Do not rely solely on PIXEO.
• Some locations may require permits or have restricted access. It is your responsibility to verify this before visiting.
• PIXEO makes reasonable efforts to exclude dangerous or illegal locations but cannot guarantee this in all cases.

BY USING PIXEO YOU AGREE TO RELEASE, DISCHARGE, AND HOLD HARMLESS PIXEO INC., its officers, directors, employees, and agents from any and all claims, damages, injury, loss, or liability of any kind arising from or related to visiting any location discovered through PIXEO, to the fullest extent permitted by applicable law.

The PIXEO name, logo, website design, app design, and all original content produced by PIXEO Inc. are the intellectual property of PIXEO Inc. and may not be reproduced, distributed, or used without prior written permission.

Location photos displayed on PIXEO remain the copyright of their respective photographers, as attributed. If you believe your copyrighted content has been used on PIXEO without authorization, please contact oc.oexip@ofni.

PIXEO integrates third-party services to deliver its features. Your use of these services through PIXEO is subject to their respective terms of service and privacy policies:

• Firebase (Google): authentication, database, and file storage
• Google Maps: interactive maps and location data
• Google Analytics: website usage tracking
• Brevo: email newsletter delivery
• Apple: Apple Sign In and App Store billing
• Google: Google Sign In and Google Play billing

PIXEO is not responsible for the practices, terms, or content of any third-party service.

To the maximum extent permitted by applicable law, PIXEO Inc. shall not be liable for any indirect, incidental, special, exemplary, or consequential damages of any kind arising from or in connection with your use of PIXEO services, including but not limited to:

• Loss of data or content
• Loss of revenue or profits
• Personal injury or property damage
• Service interruptions or errors

Our total liability to you for any claim arising from these terms or your use of PIXEO shall not exceed the amount you paid to PIXEO in the 12 months preceding the claim, or $100 CAD, whichever is greater.

These Terms and Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these terms or your use of PIXEO shall be resolved exclusively in the courts of Ontario, Canada. By using PIXEO, you consent to the jurisdiction of those courts.
